For the situation 1, shouldn’t the following sentence have a different kanji for 「みる」 – 「診る」?
Yes, you are correct.
The kanji for みる are quite a few, so some people, such as children, can’t strictly distinguish among them. In such cases, it’s acceptable to use the general word 見る, as in the English word “see.”
For those who can use them properly, like you, I recommend using 診る for later use.
